Terms of Service

1. Acceptance of Terms

By accessing or using the Sonora App (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of the Terms, you may not access the App. This agreement is between you and **Cognitive Ltd.** and not with Apple Inc. (“Apple”). Cognitive Ltd. is solely responsible for the App and its content.

2. Use of the App 

You must be at least 16 years old to use the App. You are responsible for keeping your account and password confidential. You agree to use the App only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else’s use and enjoyment of the App.

3. Intellectual Property

The App and its original content, features, and functionality are owned by Sonora and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. Maintenance and Support

Sonora is solely responsible for providing any maintenance and support for the App. Apple has no obligation to provide any maintenance or support services.

5. Warranty

The App is provided “as is” without warranty of any kind. Sonora does not make any representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App. Sonora does not guarantee that the App will be uninterrupted or error-free. Apple provides no warranty whatsoever with respect to the App.

6. Product Claims and Limitation of Liability

Sonora is responsible for addressing any product-related claims, including but not limited to claims arising from product liability, consumer protection, intellectual property infringement, or any other legal claims. To the fullest extent permitted by applicable law, Sonora shall not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a “terrorist supporting” country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.

8. Third-Party Terms

If the App allows you to access or interact with any third-party services, you agree to comply with the terms of service of those third-party service providers.

9. Termination

We may terminate your access to the App, with or without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of this Agreement that by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Gibraltar, without regard to its conflict of law provisions.

11. Changes to these Terms

We reserve the right to modify these Terms at any time. We will post any changes on our website and notify you as required by law.

13. No Conflict with Apple Terms

These Terms are in addition to, and not in lieu of, any other terms and conditions applicable to your use of the App Store, and these Terms do not modify or supersede any such other terms and conditions. —
